Service: PFAS Packaging Check and related websites, applications, and services (the “Service”)
By accessing or using the Service, you agree to these Terms of Service (“Terms”). If you use the Service on behalf of a business, you represent that you have authority to bind that business, and “you” includes the business.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to provide notice through the Service or by email. Continued use after the effective date of updated Terms means you accept the updated Terms.
3.1 No legal advice. The Service provides general regulatory information derived from publicly available sources and other third-party information. The Service is not a law firm, does not provide legal services, and does not provide legal advice.
3.2 No attorney-client relationship. Your use of the Service does not create an attorney-client relationship or any fiduciary relationship.
3.3 No compliance determination. The Service does not determine whether you are compliant with any law, regulation, or standard. Any labels, indicators, summaries, dashboards, alerts, or reports are informational and may be based on automated categorisation and your inputs.
3.4 You are responsible. You are solely responsible for (a) determining what laws apply to your activities, products, and jurisdictions, (b) verifying requirements by reviewing the cited source materials, and (c) obtaining advice from qualified counsel and other professionals as appropriate.
4.1 You may need an account to use certain features. You must provide accurate information and keep it up to date.
4.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4.3 You must promptly notify us of any suspected unauthorised use of your account.
5.1 Plans. Some features require a paid subscription. Plan details and pricing are described on our pricing page or in the Service.
5.2 Trials. If we offer a free trial, you may cancel before the trial ends to avoid charges. Trial eligibility may be limited.
5.3 Billing. You authorise us (and our payment processors) to charge subscription fees, applicable taxes, and any other charges you incur in connection with your account.
5.4 Cancellation. You can cancel at any time through your account settings or by contacting support. Unless required by law, subscription fees are non-refundable and your cancellation will take effect at the end of the current billing period.

7.2 “Last verified” and source citations. Where we display “last verified” timestamps or citations, those are provided for transparency but do not guarantee completeness or correctness.
7.3 Alerts. Regulatory alerts are provided as a convenience and may be delayed, incomplete, or unavailable. You should not rely on alerts as your only method of monitoring legal changes.
8.1 Your content. You may upload documents and other materials (“User Content”). You retain ownership of User Content.
8.2 Licence to operate the Service. You grant us a limited licence to host, store, process, transmit, and display User Content solely to provide and improve the Service.
8.3 No sensitive uploads. You should not upload highly sensitive information unless you have assessed the risks and ensured you have appropriate rights and consents. You are responsible for ensuring you have all rights required to upload User Content.
8.4 Deletion. We may retain and delete User Content in accordance with our data retention practices and applicable law. Details may be described in our Privacy Policy.
9.1 Third-party suppliers. The Service may include a directory of suppliers or links to third-party websites, products, and services.
9.2 No endorsement; no warranties. We do not control third parties and do not endorse, warrant, or guarantee any third-party product, service, certification, or claim. Any supplier information (including claims of “PFAS-free” status or certifications) is provided for convenience and may be inaccurate or incomplete.
9.3 Your due diligence. You are responsible for evaluating suppliers, performing due diligence, and ensuring any products you buy meet your requirements.
9.4 Affiliate disclosure. We may receive referral fees or commissions when you purchase from certain suppliers or click certain links. We will disclose affiliate relationships where required.
9.5 No liability for third-party transactions. Any transaction between you and a third party is solely between you and that third party, and we are not responsible for any loss, damage, or dispute arising from it.
10.1 We and our licensors own all rights in the Service, including software, databases, text, graphics, and trademarks, except for User Content.
10.2 You receive a limited, non-exclusive, non-transferable licence to access and use the Service during your subscription, subject to these Terms.
10.3 Feedback. If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation.
11.1 As-is. The Service is provided on an “as is” and “as available” basis.
11.2 No warranties. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and availability.
11.3 Not a substitute. The Service is not a substitute for reviewing source laws and obtaining professional advice.
12.1 Indirect damages. To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or business interruption, arising from or related to the Service.
12.2 Cap. To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service will not exceed the total fees paid by you to us for the Service in the 12 months immediately preceding the event giving rise to the claim.
12.3 Mandatory consumer rights. Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot be excluded under applicable law (including applicable Australian consumer guarantees, if they apply to you).
You agree to indemnify and hold us harmless from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:
14.1 We may suspend or terminate access if you breach these Terms, if required by law, or to protect the security and integrity of the Service.
14.2 You may stop using the Service at any time. Termination does not affect obligations that by their nature survive (including disclaimers, limitation of liability, indemnity, and IP provisions).
These Terms are governed by the laws of Victoria, Australia, excluding conflict-of-laws rules. You submit to the non-exclusive jurisdiction of the courts of Victoria.
